Ben Driggs was born in rural Illinois and recently returned to Chicago from a two year stay in California. After receiving his BFA from Columbia College Chicago in 2004, he made props and special effects for television and film. His work instigates, documents and critiques transformational moments on a range of scales, from the study of human consciousness in a general sense to a solitary individual's lived experience. Using a variety of media and tactics, he is interested in exploring and demonstrating how fluid our consciousness can be as it shifts between perspectives.

Accused killer Jarrod Wyatt's defense attorney will take the unusual step of trying to present enough evidence at a pre-trial hearing next week to cap or throw out the murder charge prosecutors are seeking for the brutal slaying.

Wyatt is facing first-degree murder charges for killing his friend Taylor Powell, 21, at a home outside of Klamath on March 21. A Del Norte County judge will determine after the preliminary hearing whether District Attorney Mike Riese presented enough evidence of murder -- and of aggravated mayhem and torture -- to put the case before a jury.

But Wyatt's defense attorney James Fallman will present what is known as an affirmative defense, in which the defense can call its own witnesses in an effort to show that the first-degree murder charge should be reduced to a second-degree charge or be thrown out altogether. Fallman would not say whether he intends to mount an insanity defense, in which the defendant must be shown to be unable to distinguish right from wrong, or to understand the nature of his act.

Wyatt has pleaded not guilty to the charges.

Riese said that he could try to exclude the evidence Fallman brings to the preliminary hearing, but may decide not to object and gain insight into Fallman's strategy, which he likely wouldn't otherwise get until 30 days before the trial.

”I want it sooner than later,” Riese said.

According to a statement of probable cause filed with Del Norte

County Superior Court, deputies arrived at a Fizer Road residence in Requa during the early morning hours of March 21, after a man reported seeing Wyatt, a 26-year-old mixed martial arts cage fighter, in the living room with Powell's apparently dead body.

The man, Justin Davis, had been there earlier in the day and saw Wyatt acting strangely after drinking “some kind of mushroom tea,” according to the statement. Davis left for Crescent City, but returned later to pick up his dog. Davis arrived to find Wyatt standing in the living room naked and covered with blood, according to the statement. Wyatt told Davis, according to the statement, that he was going to cut out Powell's heart. Davis went to a nearby pay phone to call law enforcement.

A deputy arrived at the residence and reportedly saw Wyatt on the couch with Powell's body, which was covered in blood and had most of its face removed. A large incision in the chest could be seen, and other unspecified body parts had been removed. An eyeball was resting in the middle of the room, according to the statement.

Wyatt allegedly told the deputy that he'd cut Powell's heart out and thrown it into the fire.

Powell's death certificate reads that he died from having his heart removed while he was still alive, causing him to bleed to death. It also lists as significant blunt force trauma to the head and neck, and compression of the neck.

The deputy reported finding blood throughout the house, making the entire residence a crime scene. Large indentations in the sheetrock in the bathroom could be seen, the statement said, which appeared to have been made by the back of someone's head.

What appeared to be wild mushrooms were in the kitchen, the deputy reported. The deputy also discovered a marijuana garden in the house when he went to search for additional victims, the statement reads.

According to the statement, Wyatt was read his Miranda rights and transported to Del Norte County jail, where Wyatt repeatedly said he'd killed his “Taylor.”

The defense strategy of mounting an affirmative defense at the preliminary hearing, say legal experts, can be risky, but it can also be a means to motivate a plea bargain. The defense must show that the majority of its evidence goes to disprove the charge, a higher bar than the prosecution must meet to show there is sufficient probable cause to support the charge.

Law professor Franklin Zimring, who directs the criminal justice research program at University of California at Berkeley Boalt Hall's Earl Warren Legal Institute, said that there doesn't seem to be much doubt over who did what in Wyatt's case.

”The question is criminal responsibility,” Zimring said.

Zimring said that showing one's client was insane at the time of a murder could be a means of showing that a trial is likely to be long and complicated, which can be a motivation to press the prosecution to plea bargain.

On the other hand, the defense presenting evidence at a preliminary hearing can reveal the strategy it intends to pursue at trial -- but months before it otherwise would have to. The defense does not have to turn over its discovery until 30 days before the start of a trial, which in Wyatt's case could be a year or more away.

Stanford Law School Criminal Justice Center Academic Director Robert Weisberg said that the value of the affirmative defense in a case like Wyatt's is not necessarily to prevent the case from going to trial, but rather to persuade the judge to cap the charge at second-degree murder. The defense may try to show that the evidence of premeditation -- a necessary element in many first-degree murder cases -- is substantially lacking, possibly due to a “lack of clarity of consciousness” from using drugs, Weisberg said.

Fallman would not say why he is seeking an affirmative defense, and said he can't comment on Wyatt's current mental state. Fallman said that he's going to exercise all viable plea options, and that he has not been approached with any reasonable plea agreements yet.

In another twist, Justin Davis -- likely a key witness -- was arrested last week at his Crescent City residence near a city administrative building on suspicion of growing marijuana, possessing marijuana for sale, possession of a dangerous weapon and a parole violation.

Both Fallman and Riese said that the arrest would make no difference to their cases.

The preliminary hearing is currently scheduled for May 26.

Arcata Police report rash of bad LSD trips

A recent rash of what appear to be bad acid trips has caught the attention of the Arcata Police Department, which is warning people who may use the drug.

It started on April 18, when officers responded to a residence to help Arcata-Mad River Ambulance personnel with a 31-year-old man who had just castrated himself. Medics and officers couldn't find the man's testicles, according to APD, and he later told police that he'd flushed them down the toilet because they contained “monsters.”

Then, beginning on May 8, the incidents picked up. A 21-year old man took LSD and wandered from his home without adequate clothing or shoes and without saying where he was going. The man wandered in the forest for two days while his family and friends looked for him. He returned two days later, according to police.

The next day, police were called to Mad River Hospital to assist with a combative 19-year-old man reportedly undergoing flashbacks -- two weeks after he took LSD.

On May 12, officers found him struggling with three friends trying to get him to go to the emergency room. The friends asked officers for help, and they detained the subject and held him for psychological evaluation by Humboldt County mental health workers.

On May 11, officers were dispatched to the 900 block of H Street where an 18-year-old man under the influence of LSD was throwing himself on the ground in the middle of the street, APD said. He was arrested and taken to jail. The same night, Arcata police helped Humboldt State University police arrest a subject on LSD. Another officer reportedly made contact with two other people having flashbacks, both of whom were cared for by friends and family.

Arcata Police Chief Tom Chapman said the department has not recovered any samples of acid in relation to the incidents, and could not say whether the recent events are due to contaminated LSD or a sharply increased usage of the drug.
”I hate to call it a bad trip,” Chapman said, “but they're having a bad trip.”

Chapman said people using the drug can become a danger to themselves and others, and that its use can trigger a mental health “break” in someone with underlying mental health issues.

I thought we'd end up playing Wii after dinner at my friend's house, but someone came up with the coolest party game ever. You'll need a magic marker. Everybody's got a paper and pencil. Somebody calls out a cartoon/video game character like Lion-O or Bowser or something. Can you remember? Start the timer 2 minutes. Draw it! Time's up. The drawings go on the table face down. Mix them up and flip them over one by one. Some are pretty OK; some are fucking terrible/hilarious. The Worst Drawing is voted on and claimed by the Worst Drawer. The Second Worst Drawer then takes the magic marker and gives a tattoo of said Worst Drawing somewhere on the Worst Drawer!

Somebody ends up looking like a total badass and the votes end up going from 'that one doesnt look like Abe Lincoln' to 'that one would be a better tattoo.' Eventually the ideas might become more tattoo oriented like the Scream mask or the TMNT logo. I wish I was playin right now.

I bought this today at a flea market for $1. I should have talked to the seller more about it - I knew it was beautiful, but my eyes were losing their bite in the ocean of objects at that point. I didn't realize how amazing it really was. It looks like the embroidering on the red fabric is machine stitched, everything else - other than the fabric itself, and the thread - was done by hand. I did ask her what it was. All she said was that "it's just for decoration."

As a video clerk in Chicago six years ago I had a regular customer, Roger Terry, who always rented his videos in uniform for the police. He would double park his squad car outside and get a good variety of DVDs. He was full of energy every time I saw him and we always talked. Once, after we had a conversation about Event Horizon, Roger returned from his car with a new copy of a book called Flatfoot, Fuzz, Pig and Screw. He told me he wrote it 25 years ago when he worked undercover vice and that, back in the day, he was known throughout the department for his ability to disguise himself. Roger worked Wicker Park in the early 80's when it was a total shithole. One regular place he would post up is the Elbo Room where he would pose as a junkie.

You might be able to tell from the cover that the book is basically a defense of police officers. There are plenty of complaints about the police not getting the respect they deserve along with descriptions of the day-to-day violence, mental stress and mountains of lies cops have to deal with.

The criminals are not afraid of the police. given the chance, they will take the officer's badge and stick it up his ass, take the gun and blow him away!

The bulk of the book takes a kind of Q&A format wherein the author will respond to comments he has received from civillians. Keep in mind this was written in 1976, although some things may be no different today.

COMMENT: My husband comes home every Friday and beats me. I call the police, but they refused to do anything.
AUTHOR: This is a very common statement made by women. Usually it is made by a woman who is afraid to have her husband arrested for fear that when he gets out of jail, he will beat her more. She is ashamed to admit, or refuses to admit, that she is afraid of her husband and therefore blames the police...

The book closes with a list of each police officer to lose his life in the line of duty since 1872.

Helena Williams

This doll was made by an artist I work with named Helena. Her pieces are executed with a very high skill level and often involve a range of media. She makes art without pause all day and considers herself above the drama of the studio - she is there to work. She apparently works at home as well because she brought this doll in on thursday to add to a sculpture of a dome house in progress. She stitched together the sweater from one of her own and sewed the pants and shoes, added earrings (bead pierced by pin) and painted facial hair and eyes. The belt was a child's watch.

I totally felt this! I thought Ash was kicking the bed to get me up, but it was God. The bumping only lasted a couple of seconds (unfortunately?). The epicenter was less than 20 miles from Petrolia, a town Ash and I visited on the way to the Lost Coast (even closer to ground zero). Petrolia has one ancient gas station/general store with old pumps whose price per gallon numbers don't go high enough. You pay double the displayed price! The town is known for having minted its own coinage. I wasn't able to get ahold of any, but this barter currency has things like salmon, solar panels, a rancher and pot leafs on it.

This is gonna rule but I can't make it, Duh! Im putting in a big sculpture at the Lumpen space, and the 88 v. 89 Topps video for the Heaven show. Chicago should go to the Halloween exhibit - looks like the Devil's work. These shows are put on by Harold Arts, an organization that is responsible for a great residency I went on this summer and plenty of other oh-so-wonderful doings.

The Curse of Half-woman Half Starfish

This piece is one of my favorite discoveries at work. Soodie is one of the funnest people to talk to because he slips in and out of different charachters. He doesn't have multiple personalities or anything like that, he just likes being goofy, just like me! Our conversations mostly involve role-playing with 'the devil demon Jessie James' and 'the dark demon lord' along with charachters from fantasy movies like Sarumon and the Emperor from Star Wars. Jokingly, he sometimes refers to me as 'My Master' as he tilts his head down to look at me through his eyebrows.

His hair is always slicked back and he usually wears head-to-toe black. Right now in the sculpture room he is working on a three foot tall Janus-faced figure: Zeus on one side and Sarumon on the other.. it is WICKED! Soodie often talks about his girlfirend Shana, and many of his drawings are filled with sexual references and situations. Clicking on the image above won't enlarge it enough to read the text contained in the painting, written in Soodies curling hand.

We're trying to rent out this really undesirable room in our apartment. It's dark, two of the walls are paneled uglily, and the only privacy will be a makeshift barrier to the kitchen and its 8am coffee grinder. We've been looking for suckers on craigslist.

So this guy contacts us, he's really interested, stranded in another town in a not-so-great situation, needs a room. Cool. He shows up early to the apartment and we're not there (he said he was going to get something engraved), so we head up our street and we see this 25 year old guy sitting on the rear bumper of his black Mercedes and for only a moment I think 'Drug Dealer Who Is Stoned.' We don't shake hands for some reason and I stare at the screws on his giant Dior shades as he first tells me he is a "broker" who "gets freight" for his friend in McKinleyville. He wears a cool polo shirt and huge, baggy pinstriped wool slacks and some kind of mod designer shoes.

"It's a multi-billion dollar business. Err.. A multi-billion dollar industry. Yeah, we ship all over the world. I just can't sleep on my friends couch anymore because of the carpet." He says he is allergic to something in the carpet.

Okay.

I can smell the skunkiest dank sticky weed smell on this guy and I kind of want to ride in his Mercedes, but I guess I just wasn't ready to penetrate the mystery and I take him into the apartment. He is totally comfortable with the room immediately and isn't interested in seeing the bathroom.

Eventually he leaves and we decide he is too shady to live with us. Later that day he calls me three times in a row and I finally pick up. He tells me he will pay any amount I can name and will install high-speed internet for us. I say 'Eh.' Poor guy.

Days later I find out his email address was something like logisticsmanagement@hotmail.com ?? and he said he was a student.

I just want to hang out with this guy and see what the fuck he is all about. I get the impression he's like a lifelong shady dude. He reminded me of the guy in high school who sold me fake acid. He also reminded me of Ali G cos he was really tall and felt unreal.

I am now an art teacher to the insane and the strange. Workdays consist of managing hug&kissers, weird starers and mumbling touretty threateners-which is not bad at all. My impression is that somehow the unfortunate people who manage to make it into adulthood with a disability become sweethearts who charm everyone who gives them the chance. I met all the clients during my first week and in the process snagged two drawings and a clay sculpture that weighs 30 pounds. One of our artists, Adam, told me that his drawings usually cost a dollar(!), but the first one is free. I bought frames on the way home for ten times what I paid for the art.

The guy who made these drawings has such a difficult life. His brother, who is also mentally disabled, was just removed from a Humboldt County juvenile detention center for being violent (to go where?) and his family is very poor. When asked to come up with titles for his work, he flips the paper over and stares at the back for minutes with his usual pouty expression. The Line Between The Living And The Dead is the title of a piece that will be in his opening next weekend.

I'm working now at a coffee shop called Has Beans. I've worked there for 3 days, but still I don't know what my hourly wage is. I'm guessing $9 or $8.5. Just realized I forgot my tips-maybe ten bucks. Today I got a call back from The Studio saying they'd hire me. It is a place for developmentally disabled adults to come and make art. The work that comes out of there is totally adorable and I want a ton of it.

It's a little surprising that my last employer gave me a good reference considering on my last day there I walked out in the middle of a high pressure shipping day-we had to make a FedEx freight deadline with 2 months of work. But then again every day was high pressure there, and needlessly so. Has Beans is about as low pressure as can be imagined. About half of my customers today either were crazy or just looked crazy. This guy Red is in there from 8:00 to 12:00 every morning asking for water and a seat in the back. He looks 30 and has old sleeve tattoos that reach over his neckline. I assume he is an acid tragedy. My boss said his parole officer (a regular at the shop) came in and told us to just let him use Has Beans as a venue for expeditions into society. He's harmless I hope.
